These terms govern instructions given to Afrimed Shipping for clearing, forwarding, transportation, warehousing and cargo inspection services, and apply to every client shipment unless a separate written agreement is in place.
1. Definitions
“Afrimed”, “we”, “us” means Afrimed Shipping, of 156 Gray Park Road, Bluff, Durban. “Client” means the party instructing Afrimed to perform clearing, forwarding, transport, warehousing or inspection services. “Goods” means the cargo covered by an instruction.
2. Scope of services
Afrimed acts as clearing and forwarding agent, and where instructed, as transport operator and warehouse keeper, for the Client’s Goods. Services include import and export clearance, customs declaration, transportation, warehousing, and cargo inspection, as agreed per instruction.
3. Client obligations
- Provide accurate, complete documentation and commodity information for every shipment
- Hold any permits, licences or certificates required for the specific Goods
- Settle invoices, duties, taxes and disbursements on the agreed terms
- Notify Afrimed promptly of any special handling, hazard classification, or storage requirement
4. Liability and insurance
Afrimed acts with reasonable skill and care but does not guarantee delivery or clearance timelines, which depend on customs authorities and third-party carriers outside our control. Afrimed’s liability for loss or damage to Goods is limited to the value declared and insured under Goods in Transit (GIT) cover, or as otherwise agreed in writing. The Client is responsible for arranging adequate marine or transit insurance unless expressly agreed otherwise.
5. Payment terms
Invoices for duties, freight and service fees are payable on the terms stated on the invoice. Afrimed reserves a right of lien over Goods in its possession or control until outstanding amounts are settled, as is standard in the clearing and forwarding industry.
6. Cancellations and delays
Either party may cancel an instruction before it commences, subject to costs already incurred. Afrimed is not liable for delays caused by customs authorities, port congestion, carrier schedules, or other circumstances outside its reasonable control.
7. Force majeure
Neither party is liable for failure to perform obligations where that failure results from circumstances beyond reasonable control, including strikes, port closures, natural disasters, or changes in law or regulation.
8. Governing Law
These terms are governed by the laws of the Republic of South Africa, and any dispute is subject to the jurisdiction of the South African courts.
